Lawfare: When Law Becomes an Instrument of War South Africa’s International Court of Justice (ICJ) case has intensified the debate over whether Israel’s military campaign in Gaza is in violation of the international laws that govern war. In a two-day public hearing on Jan. 11-12, the Israeli defense team rejected evidence brought by South Africa accusing Israel of committing genocide in Gaza. What are Israel’s arguments, and how will they hold up in court and in public opinion? What role does lawfare—that is, the use of law to achieve military objectives—play in the ongoing conflict?
